Council Awarded £115,000 Against LU
Kensington and Chelsea Council has won a legal challenge to a noise abatement notice brought by Transport for London.
Residents in the area around Earl’s Court Tube station complained that a new PS system was causing excessive noise pollution.
When noise abatement officers from Kensington and Chelsea Council investigated they recorded more than 70 announcements in one hour.
Served with a noise abatement notice Transport for London launched a legal against the order however the Council was awarded £115,000 costs at West London Magistrates Court earlier this week after London Underground Limited abandoned their appeal.
Cllr Fiona Buxton, Cabinet Member for Environmental Health, said:
“It is clear that London Underground could and should have acted far sooner to mitigate the effects of this loud PA system.
“Even after the Council intervened, London Underground failed to take the correct action needed to make the PA system more bearable for local residents.
“Both the volume and frequency of announcements were unnecessarily high, causing constant irritation to local residents.”
